Dr. Fauci: Judge ‘Superseded’ CDC Authority In Mask Ruling

(Republican Insider) – It doesn’t seem that Dr. Anthony Fauci, good old “Dr. Doom” as I like to call him, has a very good understanding of how our government operates. Or he does, but really doesn’t care and just wants to keep himself in the spotlight and keep the American people living in terror of an illness that is rapidly losing steam.

According to a report from WND, the Centers for Disease Control And Prevention is just an advisory agency that proposes health guidelines for the executive branch of our government. But Fauci recently complained in an interview that the federal court that put a block on the current administration’s federal transport mandate “superseded the authority of the CDC.”

Again, that’s not how this works. Fauci should be well aware of this. If he’s not, someone needs to get him up to speed. But I have a sneaking suspicion he just does not care about how the law operates in this country.

During an interview with the Tennessean newspaper of Nashville — he must be really desperate to give interviews these days — Fauci stated that the mask mandate was extended due to the fact the CDC “wanted to see what the pattern of infection is during this bit of a surge we’re seeing [in areas of the country].”

“I think it’s unfortunate that a court order came in and, I believe, superseded the authority of the CDC,” Fauci, the director of the National Institute of Allergy and Infectious Diseases, went on to say.

During another interview he conducted with CNN’s Katie Hunt on Thursday, Fauci stated that it’s “a CDC decision, and that’s very bad precedent when you have courts making a decision, and looking at what the basis of the decision was, it was not sound.”

“On Monday, U.S. District Judge Kathryn Kimball Mizelle ruled that the CDC failed to provide justification for the Biden administration’s extension of the mandate 15 days to May 3 and did not go through the required notice and comment period for federal rulemaking. The judge found that the mandate, in violation of the Administrative Procedure Act, was outside the scope of the CDC’s authority, calling it ‘arbitrary’ and ‘capricious,'” the report from WND stated.

“Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate,” the Trump-appointed judge went on to write.

“Major U.S. airlines immediately made masks voluntary, putting the carriers in line with major foreign airlines that already had made that move. Amtrak also dropped its mask requirement while stating ‘masks are welcome and remain an important preventive measure against COVID-19,'” the report stated.

Then, on Tuesday evening, both the Justice Department and the CDC put out a statement which said they “disagree with the district court’s decision and will appeal, subject to CDC’s conclusion that the order remains necessary for public health.”

The CDC then went on to argue that the seven-day moving average of the coronavirus has gone up.

Let’s pump the brakes for a second. The CDC is just an advisory board, right? Why are they trying to act as if they create policy and are the ones responsible for enforcing it? That’s not their role.

“However, every state that had a mask mandate has lifted it. And COVID-19 data collected by the New York Times shows that the mandates had no impact on case rates. The Manhattan Institute’s City Journal published a graph based on that data comparing the cases in the 11 states that never mandated masks with the 39 that did,” the WND report stated (screenshot here).

An article in JAMA Network, which is a publication of the Journal of the American Medical Association, stated that the “risk of contracting coronavirus disease 2019 (COVID-19) during air travel is lower than from an office building, classroom, supermarket, or commuter train.”

“And scientific studies and data accumulated from two years of mask mandates indicate they are not effective in curbing the spread of the virus,” the report added.

Hey, remember back in March 2020 when Fauci was actually against universal masking and stated as much during an interview on “60 Minutes?” He actually warned of the “unintended consequences” stating there’s “no reason to be walking around with a mask” in “the middle of an outbreak.”

Fauci then told the American people they didn’t need to wear a mask because he wanted to make sure that all frontline workers had access to them.

“However, at the time of his interview, the executive director of the World Health Organization health emergencies program, Dr. Mike Ryan, said there was ‘no specific evidence to suggest that the wearing of masks by the mass population has any potential benefit,'” WND said.

“In fact, there’s some evidence to suggest the opposite in the misuse of wearing a mask properly or fitting it properly,” he commented.

Even the World Health Organization recommended for people not to wear masks at that time unless they were sick with COVID or caring for someone who had the illness.

In March 2020, the CDC also stated that masks “are usually not recommended” in “non-health care settings.”

Florida Republican Gov. Ron DeSantis sent out a tweet on Monday right after the judge ruled on the mask mandate, going on to say it’s “Great to see a federal judge in Florida follow the law and reject the Biden transportation mask mandate. Both airline employees and passengers deserve to have this misery end.”

  1. Fauci will announce his retirement the day after the November 2022 elections, effective December 31, 2022. Why? Because the following week, the Republicans will take over both Houses, and the investigations will begin. He most likely thinks that resigning protects him from any investigation, but given Dr. Ran Paul’s tenacity, I don’t think he’ll be that lucky.

  2. Fauci and the administration enjoyed the control they had over the population. On Fauci’s part he relished the limelight. But it can’t be forgotten this man was warned about the danger of ‘gain of function’ research and chose to ignore and silence those who warned of this peril.
    I wonder how history is going to label this man.
